Belated vs revised return

Two situations bring people to this service. Either the original due date for filing the income tax return has passed and nothing was filed, or a return was filed but later turned out to have a mistake. The first is fixed with a belated return under section 139(4) of the Income-tax Act, 1961. The second is fixed with a revised return under section 139(5). For returns of FY 2025-26 (AY 2026-27), both can be filed up to 31 December 2026, or before the assessment is completed, whichever is earlier. The new Income-tax Act, 2025 applies from tax year 2026-27 onward, so these older-year rules still govern the returns being filed now.

Who needs it

  • People who missed the due date, which is usually 31 July for individuals who do not need an audit.
  • Taxpayers who forgot income such as FD interest, dividends, rent or a mutual fund sale.
  • Anyone who claimed a wrong deduction, picked the wrong ITR form or entered wrong bank details.
  • People who received a mismatch message and want to correct the return before the time limit ends.

Key rules to know

  • A late fee under section 234F of ₹5,000 applies to a belated return, reduced to ₹1,000 if total income is up to ₹5 lakh. Interest under sections 234A, 234B and 234C is charged on any unpaid tax.
  • In a belated return, most losses (business, capital gains) cannot be carried forward. Only house property loss survives.
  • Individuals without business income can choose the old tax regime only in a return filed by the due date. A belated return is taxed under the new regime.
  • A revised return fully replaces the earlier one, so it must contain every figure again, not just the correction.
  • If 31 December has passed, an updated return (ITR-U) under section 139(8A) may be possible with additional tax of 25% to 70% of the extra tax and interest. It cannot be used to lower tax or raise a refund.

A simple example

Meena is salaried and filed on time under the new regime with taxable income of ₹14,00,000. Tax was ₹90,000 plus 4% cess of ₹3,600, a total of ₹93,600. She later saw FD interest of ₹40,000 in her AIS that she had missed. Her taxable income becomes ₹14,40,000. Tax is now ₹96,000 plus cess of ₹3,840, a total of ₹99,840. The extra liability is ₹6,240. The bank had already deducted TDS of ₹4,000 on the interest, so she pays ₹2,240, plus any small interest, and files a revised return before 31 December 2026.

Can I file ITR after the due date has passed?

Yes. You can file a belated return under section 139(4) up to 31 December of the assessment year, which is 31 December 2026 for FY 2025-26. A late fee under section 234F applies, and interest is charged on unpaid tax. Filing late is still much better than not filing at all.

What is the difference between a revised return and an updated return (ITR-U)?

A revised return corrects any error, including one that increases your refund, but only till 31 December of the assessment year. An updated return under section 139(8A) can be filed up to 48 months later, but only to add income or pay more tax, and it carries additional tax of 25% to 70%.

Can I choose the old tax regime in a belated return?

Generally no. Individuals without business income can pick the old regime only in a return filed by the original due date under section 139(1). A belated return is taxed under the new regime, so deductions like HRA, 80C and 80D cannot be claimed. This is one more reason to file on time.

Will I still get my refund if I file a belated return?

Yes. A refund is paid on a belated return once it is processed, as long as the return is e-verified. The difference is that interest on the refund under section 244A is counted only from the date you file, not from 1 April. The late fee, if any, is adjusted first.

Is there a late fee for filing a revised return?

No separate fee is charged just for revising. If your original return was filed on time, the revised return carries no section 234F fee. If the original itself was belated, the fee already paid covers it. You only pay extra tax and interest if the correction actually increases your taxable income.

Can I revise my return after getting an intimation under section 143(1)?

Yes, in most cases. An intimation under section 143(1) is not a completed assessment, so revision is still possible till 31 December of the assessment year. If the intimation shows a mismatch, correcting it through a revised return is often simpler than disputing it. We check which route suits you.

What happens if I never file my income tax return?

The department may send notices asking you to file, and can assess your income on the basis of AIS data. You may face tax with interest, penalty for under-reported income and, in serious cases, prosecution. You also lose loss carry-forward and may struggle with loans or visas that ask for ITRs.

What is condonation of delay for an income tax refund?

If the belated deadline is missed and you are due a refund, you can request condonation under section 119(2)(b). You apply online explaining the genuine reason for delay. Such requests are generally accepted only within five years from the end of the assessment year, and approval is at the department’s discretion.
